Yes, they did, but do you believe they will stick with it since it failed on the first round? It’s all they got, right? Only hope.
Even if she consented they took advantage of hear while she was intoxicated and passed out. Any one can say yes earlier in the evening and then change their mind anytime! The atty’s can argue what they want it doesn’t change the fact that these boys took advantage of a girl who was intoxicated, passed out. and possibly slipped some kind of drug.
Let us hope the prosecutors the AG has on this case are experienced attys. Still have lots of questions re: that which was able to be retrieved from the cell phones. Lots of discussion about this on other sites. Something doesn’t seem quite kosher about what has been documented thus far, but I am pretty low tech. Hopefully they have found out how to retrieve info, if it does exist.
Pretty confidant that Fitzsimmons will go after adults that enabled the whole scenario (absentee parents,provision of alcohol, questionable involvement and or behaviors by select BigRed personnel, etc.)and that the victim and her family, maybe even the April JD will be well served in the Civil suits.

I think the defense will still claim consent and in the process will try to paint Jane as a slut. Its really all they’ve got. But.. fact remains consent, even prior consent, goes right out the door when one becomes impaired by alcohol, drugs or what have you.
